RE: YOUR COMMENTS TO THE DRAFT PROPOSED REGULATIONS TO IMPLEMENT “The Propane and Liquefied Petroleum Gas Act”
are requested by 5-30-2008

Dear PAPGA Member and Fellow PA Propane Marketers:

You have an opportunity to participate in what may be a once in a lifetime opportunity.  The Pennsylvania Department of Labor and Industry (L&I) has provided our association with a copy of the draft proposed propane gas regulations for our review and comment. 

These draft proposed regulations result from the passage of Act 61 (2002), the new Propane and Liquefied Petroleum Gas Act.  Prior to its passage, we had been working with the same law and regulations for over 30 years. 

We are attaching, for your convenience, a copy of (1)  Act 61 (2002), (2) a copy of draft proposed regulations dated 3-25-2008 as distributed at the PAPGA board meeting on 4-29-2008 and (3) an excel spreadsheet for you to record your comments.

Remember the regulations should not conflict with Act 61 and are only meant to explain the Act more fully.  

Please review the draft proposed regulations with a fine toothed comb and make any and all comments that you feel apply.  We would appreciate your comments not later than May 30th 2008, so that we will have the opportunity to review and consolidate them before the anticipated June Propane Advisory Board meeting.  Please be as clear and specific as possible when completing the comment form.

We cannot give any assurance that your comments will be accepted by L&I, but we will use your comments as the basis for our comments to L&I at the Propane Advisory Board meeting and subsequent discussions with the Independent Regulatory Review Commission (IRRC).

This process is expected to take at least another 1 to 2 years before finalized regulations are published and effective.
